Welcome to Prime Vacations ("we," "our," or "us"). By accessing or using our website at primevacations.in (the "Site"), mobile applications, or any of our services, you agree to be bound by these Terms of Service.

These Terms of Service govern your access to and use of the Site, including any content, functionality, and services offered on or through the Site, whether as a guest or a registered user.

Please read these Terms of Service carefully before you start to use the Site. By using the Site, booking a travel package, or clicking to accept these Terms of Service when this option is made available to you, you accept and agree to be bound by these Terms of Service and our Privacy Policy, found at primevacations.in/privacy-policy. If you do not want to agree to these Terms of Service or the Privacy Policy, you must not access or use the Site.

By using our Site, you represent and warrant that:

• You are at least 18 years of age.
• All information you provide is true, accurate, current, and complete.
• You will maintain the accuracy of such information and promptly update it as necessary.
• You have the legal capacity to agree to these Terms of Service.
• You will use the Site in accordance with these Terms of Service.
• Your use of the Site does not violate any applicable law or regulation.

You are responsible for ensuring that all persons who access the Site through your internet connection are aware of these Terms of Service and comply with them.

When you book a travel package through Prime Vacations:

3.1 Booking Confirmation

Your booking is confirmed only when we send you a written confirmation, usually via email, and after we receive your deposit or full payment, as applicable. Until such time, all bookings are considered tentative.

3.2 Payment Terms

A non-refundable deposit (typically 25% of the total package price, but may vary by package) is required to confirm your booking. Full payment is generally required 45 days prior to departure unless otherwise specified. For bookings made within 45 days of departure, full payment is required at the time of booking.

3.3 Price Guarantee

While we strive to maintain our competitive pricing, all prices are subject to change until your booking is confirmed and paid in full. After full payment, your price is guaranteed except for additional charges resulting from government-imposed taxes or fees.

3.4 Documentation

You are responsible for ensuring that all travelers in your party have valid travel documents, including but not limited to passports, visas, and health certificates required by the destinations you visit. We are not liable for any issues arising from inadequate travel documentation.

4.1 Cancellation by You

If you need to cancel your booking, the following cancellation fees apply:

• More than 60 days before departure: Deposit amount
• 45-60 days before departure: 50% of total package price
• 30-44 days before departure: 75% of total package price
• Less than 30 days before departure: 100% of total package price

All cancellations must be made in writing and sent to [email protected].

4.2 Cancellation by Prime Vacations

We reserve the right to cancel any tour, for any reason, at any time before departure. In such cases, a full refund of all payments made to Prime Vacations will constitute full settlement. We are not responsible for any additional expenses incurred in preparing for the trip (e.g., non-refundable airfare, visa fees, gear, or medical expenses).

4.3 Force Majeure

We are not liable for any failure to perform our obligations under these terms resulting from events beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, epidemic, government restrictions, transportation disruptions, or labor disputes.

Prime Vacations acts as an intermediary between you and the actual service providers (hotels, transportation companies, activity providers, etc.). We are not liable for any injury, damage, loss, accident, delay, or irregularity resulting from any act or default of any company or person engaged in providing these services.

In no event will Prime Vacations, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, including personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

The maximum liability of Prime Vacations in connection with your booking shall be limited to the cost of your package paid to Prime Vacations.

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Prime Vacations, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

These Terms of Service and any disputes arising out of or relating to these Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any legal suit, action, or proceeding arising out of, or related to, these Terms of Service or the Site shall be instituted exclusively in the courts located in Gurugram, Haryana, India. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

We may revise and update these Terms of Service from time to time at our sole discretion. All changes are effective immediately when we post them.

Your continued use of the Site following the posting of revised Terms of Service means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.
